The arbitration is an extrajudicial method to resolve controversies, regulated in Brazil by Laws 9.307/96 and 13.140/15. It allows companies, when a dispute arises as a result of a contractual relation, to choose an arbitrator that will have the job to solve the impasse emerged in the contract. The sentence delivered by the arbitrator is just as effective (equivalent) as a court sentence.
The establishment of the arbitration procedure depends on the consent of everyone involved, wich can be manifested through a commitment clause, incorporated previously in a contract, and/ or upon a specific agreement, called arbitral commitment, consolidated after the dispute has already arisen.
